1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) via the online shop Holder's Handmade Heaven.
Any differing terms and conditions of the customer shall not apply unless we expressly agree to them in writing.

2. Contracting parties and conclusion of the contract

The purchase agreement is concluded with:

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
By clicking the "Buy now" button, you are placing a binding order for the products contained in the shopping cart.
Confirmation of receipt of your order will be sent immediately via email after submission. A binding contract is only formed upon our acceptance.

3. Special characteristics of handmade products

Our products are handcrafted, unique pieces. Therefore, variations in shape, color, grain, scent, texture, or size may occur compared to the images in the online shop.
These deviations do not constitute a defect, but rather a characteristic feature of handmade goods.
Each piece is unique and may therefore differ from the product photos.

4.1 Statutory right of withdrawal for consumers

Consumers generally have a right of withdrawal in accordance with § 355 BGB.
The following information applies exclusively to consumers (§ 13 BGB).

4.2 Cancellation policy

You have the right to withdraw from this contract within 14 days without giving any reason.
The cancellation period is 14 days from the day on which you or a third party named by you have taken possession of the goods.

To exercise your right of withdrawal, you must inform us

inform us of your decision to withdraw from this contract by means of a clear statement (e.g. by letter or email).

4.3 Consequences of the revocation

If you cancel this contract, we will refund all payments received from you, including delivery costs (excluding additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us).
The refund will be made immediately and at the latest within 14 days from the day on which we received your cancellation notice.

For the refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you.

We may refuse to refund you until we have received the goods back or you have provided proof that you have returned the goods, whichever is the earlier.

The customer bears the direct costs of returning the goods , even if the original delivery was free of shipping charges.

The customer is only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

4.4 Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods which

• are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or

• are clearly tailored to the personal needs of the consumer (§ 312g para. 2 no. 1 BGB).

Since our products are handmade and made to order , the right of withdrawal is generally excluded. We explicitly point this out during the ordering process.

4.6 Right of withdrawal for business customers

Business customers (within the meaning of Section 14 of the German Civil Code) do not have a statutory right of withdrawal. Contracts with business customers are binding and can only be cancelled in accordance with statutory provisions or the contractually agreed terms.

5. Prices and shipping costs

All prices are final prices in euros and include statutory VAT.
Shipping costs may apply; these will be clearly displayed during the ordering process.

6th delivery

Delivery will be made to the delivery address specified by the customer.
Delivery dates are non-binding unless a specific delivery date has been agreed upon in individual cases.

The risk of accidental loss or accidental damage passes to the consumer only upon delivery of the goods (§ 446 BGB).

7. Payment

Payment is made using the payment methods offered in the online shop.
The purchase price is due immediately upon conclusion of the contract.

8. Retention of title

The goods remain our property until full payment is received.

9. Warranty

The statutory warranty rights apply (§§ 434 ff. BGB).
Since these are handmade products, the deviations described in section 3 do not constitute a defect.

10. Liability

We are liable without limitation for intent and gross negligence, as well as in accordance with the provisions of the Product Liability Act.
In cases of simple negligence, we are only liable for damages resulting from injury to life, body or health.
Furthermore, in cases of simple negligence, we are only liable for damages resulting from a breach of a fundamental contractual obligation, the fulfillment of which is essential for the proper performance of the contract and on which the customer may regularly rely. Liability in this case is limited to foreseeable damages that typically occur.

11. Copyright and industrial property rights

All content displayed in the online shop (texts, images, designs, products) is subject to copyright and may not be used without our consent.

12. Data protection

The collection and processing of personal data is carried out in accordance with our privacy policy, which can be viewed on our website.

13. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law only applies insofar as it does not deprive them of the mandatory legal provisions of the state in which they have their habitual residence.

14. Dispute Resolution

The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Severability Clause

Should individual provisions of these terms and conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
In place of the ineffective or unenforceable provision, the effective provision that comes closest to the economic purpose of the ineffective provision shall be deemed agreed.
